Protect Your Property
Remember that a judgment is good for 20 years so once this plague is over, the creditor can still go after you and that will make it that much harder once you are trying to get back on your feet after many businesses reopen.
Thus, I can still help you file either a Chapter 7 or Chapter 13 depending on your circumstances, to protect your property from creditors who will continue to pursue every hard earned dollar you earn.
If Possible…Don’t Delay
Also, if you are in foreclosure or behind on your mortgage, it is better to take care of it now than delay, if you are able to resume mortgage payments and pay a trustee in this current environment. As I have emphasized over and over, delay can literally destroy you and result in major loss of your property.
For example, if you are six months behind on your mortgage payment through March and delay to file for a few more months, then you may never be able to afford a plan that is feasible or workable based on your income, and you will then be forced to pursue a loan modification which leaves you subject to the mortgage company’s discretion.
Some of our clients are approved while others are not. You do not want to leave yourself open to that when your home is on the line.
Finally, in the Third Circuit, which covers New Jersey, if your vehicle is repossessed, you may have to wait months to get it back in a Chapter 13 and it may cost more than it is worth based on the current state of the law.
